Rising loss costs from social inflation, on top of economic inflation, strain insurer reserves and call liability insurance rate adequacy into question. The Keystone State is at the epicenter of this national trend, aided and abetted by litigation funding. Pennsylvania, ranked the fourth most litigious state in the union, features heavily in pharmaceutical, fertilizer and asbestos litigation. Smaller insurers not writing industrial risks are not immune from social inflation, as the phenomenon also impacts lower-level personal and commercial auto, CGL, BOP and professional liability portfolios. This session lifts the covers on social inflation and presents remedies to keep the trend from creating another liability crisis.
